CONSUMER RIGHTS – WITHDRAWAL – CANCELLATION AND RETURN CONDITIONS

 

GENERAL:

1. If you place an order electronically through the website you are using, you are deemed to have accepted the preliminary information form and the distance sales agreement presented to you.

2. Buyers are subject, with regard to the sale and delivery of the product they have purchased, to the provisions of the Law No. 6502 on the Protection of Consumers and the Regulation on Distance Contracts (Official Gazette: 27.11.2014/29188), as well as the other laws in force.

3. The shipping fees, which are the product delivery cost, will be paid by the buyers.

4. Each purchased product is delivered to the person and/or organization at the address indicated by the buyer, provided that it does not exceed the legal period of 14 days. If the product is not delivered within this period, Buyers may terminate the agreement.

5. In the event that it becomes impossible to sell the purchased product, the seller is obliged to notify the buyer of this situation in writing within 3 days from when it becomes aware of it. The total amount must also be refunded to the Buyer within 1 - 14 days.

 

IF THE PRICE OF THE PURCHASED PRODUCT IS NOT PAID:

1. If the Buyer does not pay the price of the product they purchased or cancels it in the bank records, the Seller's obligation to deliver the product comes to an end.

 

PURCHASES MADE WITH UNAUTHORIZED USE OF A CREDIT CARD:

1. If, after the product is delivered, it is determined that the credit card with which the buyer made payment was used unfairly by unauthorized persons, and the price of the sold product is not paid to the Seller by the relevant bank or financial institution, the Buyer is obliged to return the product subject to the agreement to the SELLER within 3 days, with the shipping cost belonging to the SELLER.

 

IF THE PRODUCT CANNOT BE DELIVERED ON TIME DUE TO UNFORESEEN REASONS:

1. If force majeure situations that the Seller could not foresee occur and the product cannot be delivered on time, the situation is notified to the Buyer. The Buyer may request the cancellation of the order, the replacement of the product with an equivalent, or the postponement of the delivery until the obstacle is removed. If the Buyer cancels the order; if they made the payment in cash, this amount is paid to them by WIRE TRANSFER/EFT within 14 days from the cancellation. If the Buyer made the payment by credit card and cancels, the product price is again refunded to the bank within 14 days from this cancellation; however, it is likely that the bank will transfer it to the buyer's account within 2-3 weeks.

 

THE BUYER'S OBLIGATION TO CHECK THE PRODUCT:

1. The Buyer shall inspect the good/service subject to the agreement before taking delivery of it; and shall not take delivery of a damaged and defective good/service such as one that is dented, broken, or has torn packaging, from the cargo company. The good/service taken over shall be deemed to be undamaged and sound. The BUYER is obliged to carefully protect the good/service after delivery. If the right of withdrawal is to be used, the good/service must not be used. The Invoice must also be returned together with the product.

 

RIGHT OF WITHDRAWAL:

1. The BUYER may exercise the right to withdraw from the agreement by rejecting the good, without assuming any legal and criminal liability and without giving any reason, within 14 (fourteen) days from the date of delivery of the purchased product to themselves or to the person/organization at the address they indicated, provided that they notify the SELLER through the contact information below.

DURATION OF THE RIGHT OF WITHDRAWAL:

1. If what the Buyer purchased is a service, this 14-day period begins from the date the agreement is signed. The right of withdrawal cannot be used in service contracts in which the performance of the service has begun, with the consumer's approval, before the expiry of the withdrawal period.

2. The costs arising from the exercise of the right of withdrawal belong to the SELLER.

3. In order to exercise the right of withdrawal, it is required that a written notification be made to the SELLER by registered return mail, fax or e-mail within the 14 (fourteen) day period, and that the product has not been used within the framework of the "Products for Which the Right of Withdrawal Cannot Be Exercised" provisions regulated in this agreement.

 

EXERCISE OF THE RIGHT OF WITHDRAWAL: 

1. The invoice of the product delivered to the 3rd party or to the BUYER, (If the invoice of the product requested to be returned is corporate, it must be sent together with the return invoice issued by the corporation when returning. 

2. The return form, and the products to be returned must be delivered complete and undamaged together with their box, packaging and standard accessories, if any.

 

RETURN CONDITIONS:

1. If there is a decrease in the value of the good due to a reason arising from the BUYER's fault, or if the return becomes impossible, the BUYER is obliged to compensate the SELLER's damages in proportion to their fault. 

2. In the event that the campaign limit amount determined by the SELLER is fallen below due to the exercise of the right of withdrawal, the discount amount benefited from within the scope of the campaign is cancelled.

3. FOR CAMPAIGN PRODUCTS THERE IS NO REFUND; THE POSSIBILITY OF EXCHANGE IS AVAILABLE.

 

PRODUCTS FOR WHICH THE RIGHT OF WITHDRAWAL CANNOT BE EXERCISED:

1. Products prepared in line with the BUYER's request or clearly their personal needs and which are not suitable for return, underwear bottoms, swimsuit and bikini bottoms, cosmetics, shoes, bags, single-use products, goods that carry the risk of rapid spoilage or that may have their expiry date pass, products that are not suitable for return in terms of health and hygiene if their packaging is opened by the BUYER after delivery to the BUYER, products that become mixed with other products after delivery and which by their nature cannot be separated, goods relating to periodicals such as newspapers and magazines other than those provided under a subscription contract, services performed instantly in the electronic environment or intangible goods delivered instantly to the consumer — as well as sound or image recordings, books, digital content, software programs, data recording and data storage devices, and computer consumables — cannot be returned pursuant to the Regulation if their packaging has been opened by the BUYER. In addition, the exercise of the right of withdrawal regarding services whose performance has begun with the consumer's approval before the expiry of the withdrawal period is also not possible pursuant to the Regulation.

2. In order for cosmetic and personal care products, underwear products, swimsuits, bikinis, books, copyable software and programs, DVDs, VCDs, CDs and cassettes, and stationery consumables (toner, cartridge, ribbon, etc.) to be returned, their packaging must be unopened, untried, undamaged and unused.
